MCC Approves Threshold Grant to Fight Corruption
September 12, 2007Washington, DC – MCC’s Board of Directors today approved a $20.6 million grant to help the Government of Yemen fight corruption and improve the rule of law, political rights, fiscal policy and government effectiveness through institution building and improved systems there.
MCC had suspended Yemen from eligibility for Threshold Program assistance in 2005 but reinstated the country earlier this year after the Government there undertook a series of ambitious reforms to combat corruption and improve the rule of law. MCC’s grant will support these reforms in a number of key areas, including judicial reform, election dispute resolution and enhancement of the investment climate.
“I would like to congratulate Yemen on the approval of its threshold program, which will help to accelerate many positive reforms already underway,” Ambassador John Danilovich, MCC’s CEO, said after the Board Meeting. “Since 2005, Yemen has undertaken significant reforms, and we are pleased to be supporting these efforts.”
“In large part,” Ambassador Danilovich said, “the success of Yemen’s threshold program will depend on the continued commitment of the Yemeni government. I must express my deep concern at recent reports of intimidation and harassment of Yemeni journalists.”
“Freedom of expression is of great concern to MCC, and I urge the Government of Yemen to work to protect all journalists in their country from intimidation and violence,” the ambassador said. “We will continue to monitor issues involving freedom of the press and expression closely.”
Yemen’s threshold program approved by the MCC Board today aims to decrease public sector corruption, increase capacity in the judicial sector, enhance election processes and participation, and enhance investment climate through tax reform, domestic debt management, procurement reform and customs modernization. After two years, expected results will include more efficient commercial courts and customs procedures, more transparent procurement and government ethics procedures, recognition by Freedom House of free and fair elections and increased anti-corruption prosecutions brought to verdict.
The United States Agency for International Development will oversee implementation of the program on behalf of MCC. In coordination with USAID, the U.S. Department of Treasury will implement a portion of the program.

The two-year, $20.6 million threshold program developed by the Government of Yemen and MCC is designed to improve Yemen’s performance on MCC’s Rule of Law, Control of Corruption, Political Rights, Fiscal Policy and Government Effectiveness indicators.
Specific objectives of the grant approved by the MCC Board are to decrease public sector corruption and increase capacity in the judicial sector, enhance elections and improve the investment climate through tax reform, domestic debt management, procurement reform and customs modernization.
Program Components
Strengthen the National Integrity System
• Define an anti-corruption institutional framework;
• Support the role of the Supreme National Anticorruption Authority;
• Expand judicial independence;
• Improve the quality of judges;
• Improve court effectiveness; and
• Strengthen public funds courts, courts which prosecute corruption cases
Consolidate Democratic Governance
• Support reform of the electoral process;
• Strengthen mechanisms to resolve election disputes; and
• Improve the Central Statistics Office to allow for fair redistricting
Improve Yemen’s Investment Climate
• Strengthen the tax authority’s capacity to raise revenue;
• Improve the government’s ability to manage its debt;
• Improve government contracting regulations, institutions and systems; and
• Modernize customs procedures.
Highlights of Expected Results of the Program
• The time needed to state a verdict in the commercial courts reduced from 6 months to 3;
• Customs clearance procedures reduced from 8 days to 4;
• Forty-five percent of completed procurement requests conform to new procedures;
• Twenty-five percent of government staff submit financial disclosure forms (currently none do);
• Freedom House recognizes 2009 elections as free and fair.
• The number of high-level anticorruption prosecutions brought to verdict is increased.
Implementing Partner

هيئة تحدي الألفية تقر منحة مالية مبدئية لمحاربة الفساد وتحسين الحكم في اليمن
واشنطن دي سي- أقراليوم مجلس إدارة هيئة تحدي الألفية منحةً مالية تقدربعشرين مليون دولار
($ 20مليون دولار) لمساعدة الحكومة اليمنية في محاربة الفساد وتحسين حكم القانون والحقوق السياسية والسياسات المالية وفاعلية الحكومة من خلال البناء المؤسسي وتعزيز الأنظمة.
علقت هيئة تحدي الألفية أهلية اليمن لتلقي مساعدات من برنامج العتبة (ثرشهولد) في عام 2005م إلا أنها أعادت أهليتها في بداية هذا العام بعد أن إتخذت الحكومة سلسلة من الإصلاحات الطموحة لمحاربة الفساد وتحسين حكم القانون. وستعمل منحة هيئة تحدي الألفية على دعم هذه الإصلاحات في العديد من المجالات الرئيسية منها الإصلاحات القضائية وحل النزاعات الإنتخابية وتعزيز مناخ اللإستثمار.
"أود أن أهنىء اليمن على الموافقة التي حظيت بها من قبل برنامج العتبة والتي ستساعد في تسريع العديد من الإصلاحات الإيجابية الجارية" صرح بذلك السفير جون دانيلوفيتش، المديرالتنفيذي لهيئة تحدي الألفية عقب لقاء مجلس إدارة هيئة تحدي الألفية. وأضاف "منذ عام 2005م إتخذت اليمن إصلاحات هامة ويسرنا أن ندعم هذه الجهود."
وقال السفير جون دانيلوفيتش "إن نجاح برنامج العتبة الخاص باليمن سيعتمد على الإلتزام المستمر من قبل الحكومة اليمنية". وأضاف أنه "يتوجب عليّ أن أعرب عن قلقي البالغ حيال التقارير المؤخرة حول تهديد ومضايقة الصحفيين اليمنيين".
وأضاف السفير جون دانيلوفيتش "إن حرية التعبير تشكل إهتماماً كبيراً لهيئة تحدي الألفية وعليه أحث الحكومة اليمنية أن تعمل على حماية كل الصحفيين من التهديدات والعنف في بلدهم". كما أضاف "سنستمر في رصد ومراقبة القضايا المتعلقة بحرية الصحافة والتعبيرعن كثب".
إن برنامج العتبة الخاص باليمن والذي أقرته هيئة تحدي الألفية اليوم يهدف إلى تقليص فساد القطاع العام وزيادة قدرات القطاع القضائي وتعزيزالعملية الإنتخابية والمشاركة ودعم مناخ الإستثمارمن خلال الإصلاحات الضريبية وإدارة الديون المحلية وإصلاح المناقصات والمشتريات وتحديث الجمارك. فبعد عامين ستتضمن النتائج الإيجابية المتوقعة محاكم تجارية وإجراءات جمركية أكثر فاعلية ومناقصات أكثر شفافية وإجراءات حكومية تتناسب ومسئوليتاتها وإعتراف بيت الحرية بإنتخابات حرة ونزيهة وكذا زيادة المحاكمات المتعلقة بالفساد.
ستعمل الوكالة الأمريكية للتنمية الدولية على متابعة تنفيذ البرنامج وذلك بالنيابة عن هيئة تحدي الألفية. كما ستقوم وزارة الخزانة الأمريكية وبالتعاون مع الوكالة الأمريكية للتنمية الدولية بتنفيذ جزء من هذا البرنامج.

إن برنامج العتبة بكلفة عشرين مليون وستمائة ألف مليون دولار أمريكي (20.6) والذي سيستمرلمدة عامين والذي أعدته الحكومة اليمنية و هئية تحدي الألفية يهدف الى تحسين أداء اليمن في حكم القانون ومكافحة الفساد والحقوق السياسية والسياسات المالية ومدى فعالية مؤشرات الحكومة.
إن الأهداف المحددة للمنحة المالية التي وافقت عليها هئية تحدي الألفية تهدف إلى تقليص فساد القطاع العام وزيادة قدرات القطاع القضائي وتعزيزالعملية الإنتخابية والمشاركة ودعم مناخ الإستثمارمن خلال الإصلاحات الضريبية وإدارة الديون المحلية وإصلاح المناقصات والمشتريات وتحديث الجمارك.

تعزيز نظام النزاهه الوطني
• تعريف الاطار المؤسسي لمكافحة الفساد.
• دعم دور الهئية الوطنية العليا لمكافحة الفساد.
• توسيع إستقلاليه القضاء.
• تطوير أداء القُضاه.
• تحسين فعالية المحاكم.
• تعزيز محاكم الأموال العامة والمحاكم الخاصة بقضايا الفساد.
دعم الحكم الديمقراطي
• دعم إصلاح العملية الإنتخابية.
• تعزيز أليات حل النزاعات المتعلقة بالإنتخابات
• تطوير المكتب المركزي للإحصاء لسماح بإعادة التقسيم العادل.
تطوير مناخ الإستثمار في اليمن
• تعزيز قدرات مصلحة الضرائب من أجل رفع الإيرادات.
• تحسين قدرات الحكومة في إدارة الدين.
• تحسين الأنظمة الحكومية للتعاقد وتطويرالمؤسسات والأنظمة
• تحديث الإجراءات الجمركية.
أبرز النتائج المتوقعة من البرنامج
• تخفيض الوقت المحدد لإصدار الأحكام في المحاكم التجارية من ستة أشهر الى ثلاثة أشهر.
• تخفيض إجراءات إصدار التصاريح الجمركية من ثمانية أيام الى أربعة أيام.
• توافق 45% من طلبات الشراء المكتملة مع الإجراءات الجديدة.
• تسليم 25% من موظفي الحكومة إستمارات الذمة المالية (حالية غير مفعلة)
• إعتراف بيت الحرية بإنتخابات 2009م أنها حرة ونزيهة.
• زيادة عدد المحاكمات القضائية المتعلقة بقضايا فساد كبيرة.
الشريك المنــفذ
ستعمل الوكالة الأمريكية للتنمية الدولية على متابعة تنفيذ البرنامج وذلك بالنيابة عن هيئة تحدي الألفية. كما ستقوم وزارة الخزانة الأمريكية وبالتعاون مع الوكالة الأمريكية للتنمية الدولية بتنفيذ جزء من هذا البرنامج.
