The Embassy has noted recent media reports attributing statements to the U.S. Ambassador to Yemen Stephen Seche, regarding the case of Sheikh Mohammed Ali Hassan Al-Moayad and Mohammed Mohsen Yahya Zayed. The Embassy wishes to correct and clarify the record. During a meeting with representatives of the Khawlan tribe and members of Sheikh al-Moayad's family, Ambassador Seche made a statement that clarified the U.S. legal system's process of appeals and Al-Moayyad's status within that process. At no time did Ambassador Seche make any statement about his personal belief regarding Sheikh Al-Moayad and Mohammed Zayed's guilt or innocence.
Under U.S. law, the status of Sheikh al-Moayad and Zayed is not a matter of opinion, but of legal fact, as both have been found guilty in U.S. court for conspiracy to support al-Qaeda and provide material support for Hamas. They are currently serving their sentences in a federal prison in Colorado. Defense teams for both Al-Moayad and Zayed filed a joint appeal to the United States Court of Appeals for the Second Circuit in November 2005. On November 26, 2006, the appeal was argued by the prosecution and defense before the Second Circuit. As of this date, no ruling on the appeal has been made. The judge's decision, when issued, will be made public.
بيان سفارة الولايات المتحدة حول الشيخ المؤيد ومرافقه زايد
لاحظت السفارة مؤخراً تقاريرصحفية نسبت تصريحات إلى سفير الولايات المتحدة بصنعاء ستيفن سيش حول قضية الشيخ محمد علي حسن المؤيد ومحمد محسن يحيى زايد. وعليه ترغب السفارة بتصحيح وتوضيح ذلك.
خلال لقاء ضم السفير سيش وممثلي قبيلة خولان وأفراد من عائلة الشيخ المؤيد أدلى السفير بتصريح أوضح فيه الإجراءات والعملية القانونية الأمريكية المتعلقة بالإستئناف ووضع المؤيد في هذه العملية.
وخلال اللقاء لم يرد على لسان السفيرسيش أي تصريح حول إيمانه الشخصي سواءً ببراءة أو إدانة الشيخ المؤيد وزايد.
ووفقاً لقانون الولايات المتحدة فإن وضع الشيخ المؤيد وزايد لا يمثل قضية رأيٍ شخصي بل حقيقة ً قانونيةً حيث وقد تم إدانة الرجلين من قبل محكمة أمريكية بالتآمر لدعم القاعدة وتقديم الدعم المادي لحماس. وهما الآن يقضيان الأحكام الصادرة ضدهما في سجن فيدرالي في كلورادو. وقد قام فريقا الدفاع عن المؤيد وزايد بتقديم الطعون إلى محكمة الولايات المتحدة للإستئناف " سكند سيركوت" في نوفمبر 2005.
وفي 26 نوفمبر 2006 تم مناقشة هذه الطعون من قبل الإدعاء والدفاع أمام محكمة الإستئناف "سكند سيركوت". ومنذ ذلك التاريخ لم يتم إصدار أي حكم حول الإستئناف. وعندما يصدر القاضي حكمه حول الإستئناف سيتم إلإعلان عن ذلك
